1. About the Service
Childcare Waitlist ("the Service") is operated from Ireland and provides a platform that connects parents seeking childcare with creche providers. The Service allows parents to create profiles, discover creches, and join waitlists; and allows creche administrators to manage their waitlists and communicate with prospective families.
2. Acceptance of Terms
By creating an account or using the Service, you agree to these Terms of Service and our Privacy Policy. If you do not agree, please do not use the Service.
3. Your Account
- You must provide accurate and complete information when registering.
- You are responsible for maintaining the security of your account credentials.
- You must be at least 18 years old to create an account.
- One person or organisation may not maintain more than one account of each type (parent or creche).
- You must notify us immediately if you suspect unauthorised access to your account.
4. For Parents
- You may use the Service to discover creches and apply to their waitlists.
- Joining a waitlist does not guarantee a place at any creche.
- Your application information (name, contact details, child's details) will be shared with creches you apply to.
- You are responsible for keeping your information up to date.
- Please do not include sensitive medical or health information in application notes.
5. For Creche Administrators
- You may use the Service to manage your waitlist and communicate with prospective families.
- You must ensure your creche information is accurate and kept up to date.
- You are responsible for how you handle parent and child data you receive through the Service, in compliance with GDPR and the Irish Data Protection Act 2018.
- You agree to treat all applicant information as confidential.
- You must not use applicant data for purposes unrelated to waitlist management.
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Submit false or misleading information
- Attempt to access another user's account or data
- Scrape, crawl, or collect data from the Service by automated means
- Interfere with or disrupt the Service's infrastructure
- Use applicant data for marketing, advertising, or any purpose beyond waitlist management
7. Service Availability
We aim to keep the Service available at all times but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the Service at any time with reasonable notice. During our pilot phase, the Service may be subject to more frequent updates and changes.
8. Data Protection
We process personal data in accordance with our Privacy Policy and applicable data protection law, including GDPR and the Irish Data Protection Act 2018. Creche administrators who receive applicant data through the Service are responsible for their own GDPR compliance with respect to that data.
9. Intellectual Property
The Service, including its design, code, and branding, is owned by Childcare Waitlist. You retain ownership of any content you submit (profile information, creche details). By using the Service, you grant us a licence to use your content solely for the purpose of operating the Service.
10. Limitation of Liability
The Service is provided "as is" without warranties of any kind, express or implied. To the fullest extent permitted by Irish law:
- We are not responsible for any decisions made by creches regarding admissions or waitlist positions.
- We do not verify the qualifications, safety standards, or regulatory compliance of any creche listed on the platform.
- Our total liability to you for any claim arising from the Service is limited to the amount you paid us in the 12 months prior to the claim (if any).
- We are not liable for any indirect, incidental, or consequential damages.
11. Termination
- You may close your account at any time by contacting us.
- We may suspend or terminate your account if you breach these Terms.
- Upon termination, your data will be handled in accordance with our Privacy Policy.
12. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via email or a notice on the Service. Continued use of the Service after changes constitutes acceptance of the updated Terms.
13. Governing Law
These Terms are governed by the laws of Ireland. Any disputes will be subject to the exclusive jurisdiction of the Irish courts. Nothing in these Terms affects your statutory rights as a consumer under Irish or EU law.
